Terms and Conditions
Effective Date: 30 July 2026
These Function & Event Terms and Conditions ("Terms") apply to private functions, celebrations, group events and special occasions held at CAFE CLAIRE BUTTERY ("we", "our", or "us").
By confirming a function booking with us, you agree to these Terms.
1. Function Booking and Confirmation
All function enquiries are subject to availability.
A function booking is only confirmed once:
-
the date and time have been agreed;
-
required booking information has been provided; and
-
any required deposit or payment has been received.
We reserve the right to decline any function request.
2. Function Duration and Access Time
-
Each function booking is limited to 2 hours only.
-
Customers may access the venue for setup purposes up to 1 hour before the scheduled function start time.
-
The 1-hour setup period is for preparation, decoration and arrangement only.
-
The function must finish at the agreed time.
-
Guests must vacate the venue at the end of the 2-hour function period to allow preparation for the next booking.
Additional time cannot be guaranteed and may not be available.
3. Decorations and Setup
Customers may bring their own decorations subject to approval by CAFE CLAIRE BUTTERY .
Customers must:
-
set up and remove their own decorations within the allocated time;
-
avoid causing damage to walls, furniture, equipment or café property;
-
ensure decorations are safe and suitable for the venue.
The following are not permitted unless approved in advance:
-
items that may damage the venue;
-
unsafe decorations;
-
materials that create excessive cleaning requirements.
Customers are responsible for removing all decorations and personal items after the function.
4. Food and Cake Arrangements
CAFE CLAIRE BUTTERY does not provide food packages for private functions unless specifically arranged and agreed before the event.
Customers may bring:
-
their own cake;
-
their own decorations; and
-
their own food for the function.
Customers who would like CAFE CLAIRE BUTTERY to provide food or catering must discuss arrangements with us before the event. Any agreed food or catering services will be subject to separate charges and arrangements.
Customers are responsible for ensuring any outside food brought to the venue is safe, suitable and handled appropriately.
5. Alcohol Policy
Alcohol is strictly not permitted at any function held at CAFE CLAIRE BUTTERY.
This includes:
-
alcohol brought by customers;
-
alcohol provided by guests;
-
alcoholic drinks served or consumed during the function.
We reserve the right to refuse service or require removal of alcohol from the premises.
6. Guest Numbers
Customers must provide accurate guest numbers before the function.
Changes to guest numbers must be discussed with us and are subject to venue capacity and availability.
The customer is responsible for ensuring all guests follow these Terms.
7. Customer Responsibilities
The customer and their guests must:
-
treat staff, other customers and the venue with respect;
-
follow reasonable instructions from café staff;
-
keep the venue clean and tidy;
-
supervise children at all times;
-
avoid behaviour that is disruptive, unsafe or inappropriate.
We reserve the right to end a function early if behaviour creates a safety risk, causes damage, or breaches these Terms.
8. Cleaning and Damage
Customers are responsible for any damage caused by themselves, their guests or suppliers.
Additional cleaning or repair costs may apply where there is:
-
excessive mess;
-
damage to furniture, equipment or property;
-
failure to remove decorations or personal items.
9. Payments and Charges
Any applicable:
-
booking fees;
-
deposits;
-
venue hire charges;
-
agreed food or beverage charges; or
-
additional costs
will be communicated before the function is confirmed.
Payment deadlines must be followed as advised by us.
10. Cancellation and Changes
Customers should notify us as soon as possible if they need to cancel or change their function.
Cancellation terms, including any applicable deposit conditions, will be advised at the time of booking.
Changes are subject to availability.
11. Personal Belongings
Customers and guests are responsible for their personal belongings.
To the maximum extent permitted by law, CAFE CLAIRE BUTTERY is not responsible for lost, stolen or damaged items.
12. Food Allergies and Dietary Requirements
Customers must inform us of any known allergies or dietary requirements if food or beverages are provided by CAFE CLAIRE BUTTERY.
While we take reasonable care, we cannot guarantee an allergen-free environment due to shared preparation areas.
13. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights available under the Australian Consumer Law or other applicable legislation.
14. Liability
To the maximum extent permitted by law, CAFE CLAIRE BUTTERY is not responsible for loss, damage or injury caused by matters outside our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the jurisdiction of the courts of New South Wales.
